Terms & Conditions
Effective August 30, 2026
By booking a singing telegram or other service from A Musical Surprise, you agree to these terms.
Booking & Payment: Bookings are confirmed after payment is received. Customers are responsible for providing accurate date, time, location, recipient, contact, and special-request information.
Performance Times: We make every effort to arrive at the scheduled time. Traffic, weather, parking, access, and other circumstances may occasionally cause delays.
Songs & Personalization: Song selections and personalized messages are subject to performer availability and package limits. We may decline unlawful, threatening, abusive, or inappropriate content.
Cancellations: Cancellations 72 or more hours before the performance receive a full refund. Cancellations 24–72 hours before may receive a partial refund or credit. Cancellations less than 24 hours before are generally non-refundable. Rescheduling is subject to availability.
Recipient Unavailable: If the performer arrives at the correct location and the recipient cannot be located or accessed after reasonable attempts, the booking may be considered completed and may not be refundable.
Weather & Emergencies: Severe weather, emergencies, unsafe conditions, road closures, or other circumstances beyond our control may require a performance to be delayed, relocated, rescheduled, or canceled. We will make reasonable efforts to find a solution.
Safety & Conduct: Performers may refuse or end a performance because of threatening, abusive, harassing, or unsafe behavior. No refund is guaranteed when a performance is ended because of unsafe conditions or inappropriate conduct.
Travel & Parking: Additional travel or parking charges may apply when disclosed during booking or when unusual access requirements create additional costs.
Third-Party Locations: Customers are responsible for obtaining permission for performances at businesses, venues, hotels, workplaces, or other third-party properties.
Liability: To the extent permitted by law, liability for a booking is limited to the amount paid for that booking. A Musical Surprise is not responsible for indirect or consequential losses.
Governing Law: These terms are governed by the laws of the State of Texas.
A Musical Surprise, a DBA of Jaybird Empire LLC, may update these terms from time to time. The terms in effect when a booking is made apply to that booking.

A Musical Surprise respects your privacy.
We collect information you provide when making a booking or contacting us, including your name, contact information, performance address, recipient information, song selections, and special requests.
We use this information to process bookings, communicate with customers, provide performances, process payments, and operate our business.
We do not sell your personal information.
Payment information may be processed by third-party payment providers. We do not intentionally store complete credit-card information.
We may use third-party services for website hosting, scheduling, communications, payments, and other business operations.
We may retain booking information as reasonably necessary for business, accounting, legal, and customer-service purposes.

Cancellation & Refund Policy
Because performances are scheduled specifically for each customer:
72+ hours before the performance: Full refund.
24–72 hours before the performance: Partial refund or booking credit may be offered.
Less than 24 hours before the performance: Generally non-refundable.
Rescheduling: We will make reasonable efforts to accommodate a new date or time, subject to performer availability.
Personalized or special-order items: May be non-refundable once preparation or purchase has begun.
Cancellation by A Musical Surprise: We will make reasonable efforts to reschedule the performance or provide an appropriate refund.
Approved refunds will generally be returned to the original payment method.
Cancellation or refund requests should be submitted through our website or the contact information provided with your booking.
By completing a booking, the customer acknowledges and agrees to this Cancellation & Refund Policy.
